ADIF welcomes Delhi HC's ruling in trademark case

The Delhi High Court has ruled that Google's Ads Programme is liable for trademark infringement, stating that Google cannot claim "safe harbour" protection as an intermediary if it uses trademarks as keywords in its ads. The ruling followed an appeal by Google against a lawsuit by Agarwal Packers and Movers, which claimed that the use of its trademark and similar keywords in the programme diverted traffic from its site. The court found that Google was a "pervasive" advertising business and noted that the company benefited significantly from keyword sales, while actively suggesting keywords to advertisers.
